By accessing or using the website calgarylistings.com (the "Site") or any services offered by CalgaryListings Group ("we," "us," "our," or "the team"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

These Terms apply to all visitors, users, and others who access or use the Site. Your continued use of the Site following the posting of any changes to these Terms constitutes acceptance of those changes.

Services Described

CalgaryListings Group is a real estate team operating under eXp Realty, licensed by the Real Estate Council of Alberta (RECA). Our Site provides:

• Access to Calgary MLS® listing data through our IDX/Pillar 9™ licensed search tools
• Real estate market information, community profiles, and educational content
• Tools for buyers and sellers including mortgage calculators, home valuation requests, and property alert sign-ups
• Contact and consultation request forms to connect with our real estate team
• General information about communities, home types, and the Calgary real estate market

Use of our Site does not create a client-agent relationship. A formal agency relationship is only established through a signed representation agreement between you and CalgaryListings Group / eXp Realty.

MLS® Data & Listing Information

Listing data displayed on our Site is sourced from the Pillar 9™ MLS® System through the Calgary Real Estate Board (CREB®), under licence from the Canadian Real Estate Association (CREA).

Listing information is updated regularly but may not reflect the most current status of any property. All listing information should be verified independently before making any real estate decisions. We make no representations or warranties as to the accuracy, completeness, or timeliness of listing data.

Listing data displayed on this Site is for the personal, non-commercial use of consumers. Any other use requires the prior written consent of CREA or the applicable listing broker.

Permitted Use

You may use our Site for lawful purposes and in accordance with these Terms. Specifically, you are permitted to:

• Search and view Calgary MLS® listing data for your own personal, non-commercial use
• Use our calculators and tools for personal financial planning related to real estate
• Contact us to request information, schedule consultations, or engage our real estate services
• Share individual listing links for personal, non-commercial purposes
• Access educational content, guides, and market information we publish on the Site

Prohibited Conduct

You agree not to use our Site in any way that:

• Scrapes or harvests data — automated scraping, crawling, or bulk downloading of listing data, contact information, or any other content from this Site is strictly prohibited without prior written consent
• Reproduces listing data commercially — using MLS® listing data for commercial purposes, including republication, redistribution, or resale, is prohibited without authorisation from CREA and the applicable listing broker
• Misrepresents identity — impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity
• Interferes with site operation — transmitting viruses, malware, or other harmful code; attempting to gain unauthorised access to our systems; or otherwise interfering with the proper functioning of the Site
• Violates applicable law — using the Site for any unlawful purpose or in violation of any applicable local, provincial, federal, or international law or regulation
• Sends unsolicited communications — using contact information obtained through our Site to send unsolicited commercial messages
• Reverse engineers — attempting to decompile, reverse engineer, or otherwise extract source code from the Site

We reserve the right to terminate access for any user who violates these Terms.

Intellectual Property

All content on this Site — including but not limited to text, images, graphics, logos, community profiles, market reports, guides, videos, and the overall site design — is the property of CalgaryListings Group or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

The CalgaryListings Group name, logo, and related marks are trademarks of CalgaryListings Group. You may not use our trademarks without our prior written consent.

MLS®, Multiple Listing Service®, REALTOR®, and the associated logos are trademarks owned by the Canadian Real Estate Association (CREA). Used under license.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes. This licence does not include the right to reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site.

No Guarantee of Results

Real estate transactions involve risk and uncertainty. Information provided on this Site — including market analyses, community profiles, price estimates, home valuations, calculator outputs, and general real estate advice — is provided for informational purposes only and does not constitute professional real estate, legal, financial, or tax advice.

Past performance of the Calgary real estate market does not guarantee future results. Home values and market conditions change. Any estimate of home value provided through our Site is an estimate only and should not be relied upon as a professional appraisal.

We make no guarantee that:

• Any property you purchase will appreciate in value

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CALGARYLISTINGS GROUP, ITS TEAM MEMBERS, EXP REALTY, AND THEIR RESPECTIVE OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT.

This includes damages for loss of profits, loss of data, loss of goodwill, business interruption, or any other commercial damages or losses, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or relating to your use of the Site exceed the greater of (a) the amount you paid us, if any, in the 12 months preceding the claim, or (b) $100 CAD.

As licensed real estate professionals, we are required to act in the best interests of our clients and to disclose any conflicts of interest. When acting as your agent, we owe you fiduciary duties including loyalty, confidentiality, disclosure, obedience, and reasonable care.

Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of the Province of Alberta, sitting in the City of Calgary.

Before initiating any formal legal proceeding, you agree to first contact us in writing and provide us with a reasonable opportunity — not less than 30 days — to resolve the dispute informally.
